This proposal covers website development as described in the original contract. The creation of new pages or functionality outside of the scope of this contract may incur additional charges. Balance due is payable by credit card (VISA, MASTERCARD, or DISCOVER), or PayPal.
All client deliverables should be provided in suitable digital format as requested by MarketMyBusiness.Net. Should there be a requirement for additional digital manipulation outside the scope of this contract (resizing, recoloring, format changes, etc) or should additional graphics or professional photography services be required, the client will reimburse MarketMyBusiness.Net for such charges unless otherwise specified herein. Additional estimated expenses in these instances shall be presented to client prior to being incurred and the client shall retain the sole discretion on initiating such charges.
Additional site changes not specified in this or other contracts with the client or covered in specific by the support contract details may require additional charges. The client will be notified in such an instance and will retain sole discretion on initiating such charges.
MarketMyBusiness.Net is not responsible for delays in project completion due to lack of timely assembly of client deliverables or changes made to the scope of work following initiation of the contract. Should MarketMyBusiness.Net or the client determine the need for advanced page elements or other features which are not included in the original project scope, thus requiring an enlargement of the original scope, any increase in the project cost due to such enlargement will be presented to the client for approval. The client will make the final decision regarding such a scope increase.
Project payment timelines may be offered as a courtesy to client without financing charges. Should site be completed and placed on a live server prior to completion of payment, client enters a probationary period requiring timely payment. Should payment not be made, the full outstanding balance will be due immediately and shall include a late fee of 10% of the outstanding balance or $200, whichever is less. Websites and related services may be suspended until such time as payment is received. Upon completion of payment, client probationary shall end, at which time client shall be considered the sole and complete owner of the website and content made available via this project. Client should direct questions about payment plans and pricing structures to the Project Director.
Annual hosting costs are established via contract for the life of the site detailed in the original client agreement. Should there be hosting rate increases in the future, existing clients in good standing and covered by a maintenance contract shall not have their hosting rates increased. Hosting rates are fixed for the duration of the project presented herein when coupled with annual maintenance contract.
Should annual hosting fees remain unpaid for thirty days past the renewal date of the hosting contract, the account will be subject to suspension. Suspended hosting accounts require payment of outstanding balances (unpaid monthly amount based on the full monthly rate of the previous contract) and a reconnection fee equal to 20% of previous contract amount or $100, whichever is less) to be reconnected. New hosting agreements shall then be according to the current pricing structure at that time. Client forfeits “life of project” hosting pricing if account is suspended.
Annual maintenance contract shall be subject to annual review based on the previous year’s activities. Should additional contract hours be required, the client will be notified prior to implementation of updated contract charges. The client shall retain sole discretion in agreeing to updated pricing or other changes to the scope of the maintenance contract.
Upon request, MarketMyBusiness will turn project management over to the client; however, doing so will void any and all existing contracts and work orders. Subsequently, any site design, development, implementation, editing, or support following a surrendering of site maintenance will be billed at the full rate of $100/hour.
Payment toward this contract or toward annual maintenance or hosting contracts constitutes acceptance of terms. All payments are retainers for services and are non-refundable.
